Why
do I need to file my business name?
Because state law requires that you do. You also need
a legal record to prevent somebody else stealing your
company name. You will also find it impossible to open
a business bank account, or get a business license,
without filing.
Why
do I need to publish?
Again, because state law requires that you notify the
general public that you are operating under a Fictitious
Business Name. Here is an extract from the County Recorder’s
Website of the relevant State Law:
“Prior to opening a business,
a business name must be selected that is not already
in use and then registered. Business and Professional
Code 17918 specifies "No person transacting business
under a fictitious business name contrary to the provisions
of this chapter, or his assignee, may maintain any action
upon or on account of any contract made, or transaction
had, in the fictitious business name in any court of
this state until the fictitious business name statement
has been executed, filed, and published as required
by this chapter. For the purposes of this section, the
failure to comply with subdivision (b) of Section 17917
does not constitute transacting business contrary to
the provisions of this chapter."
“The fee is $23.00 for the first Fictitious Business
Name and up to two(2) registrants and $4.00 for each
additional name."
“State law requires that within 30 days the registrant
must publish a statement in a newspaper of general circulation
in the county in which the principal place of business
is located.”
What
if I forget to publish within the required 30 days?
You will need to re-file – and pay the county
all over again.
Do
I need to renew?
Yes, every five years after your first filing date.
Why should

What

you a copy of the newspaper containing your ad. After
four weeks we file a proof of publication affidavit
with the County. When they have processed that (five
business days) and given us a copy, we send it to you.
